General Terms

Gosselin offers a variety of photography and video products and services, including equipment sales, printing services, and training. Product and service descriptions and prices may be changed without notice.

Additional conditions may apply to the purchase of goods or services, including in the context of contests, training, promotions, or the offering of new products and services. These additional conditions form an integral part of these Terms and are deemed incorporated herein by reference.

Regarding the availability of spare parts, repair services, and maintenance and repair information:
Please note that Gosselin Photo Vidéo inc. cannot guarantee the availability of spare parts, repair services, or maintenance and repair information for all products as required under Quebec's Consumer Protection Act.

Orders and Payments

Online Orders:  Orders may be placed through the Website. Gosselin reserves the right to refuse or cancel any order for any reasonable or commercial reason, including product availability or errors in product descriptions. To that end, Gosselin reserves the right, to the extent permitted by applicable laws, to correct any pricing or product/service availability errors without notice, including after you have completed an order.

Payments: Payments are made online via secure methods.

Gosselin accepts various forms of payment, including credit cards (Visa, MasterCard), Gosselin gift cards, and financing through Flexiti (subject to credit application and approval). For more information, please visit our Flexiti financing page.

Delivery

Service Areas: Gosselin delivers anywhere in Canada. However, additional charges apply for the Yukon, Northwest Territories, and Nunavut. Any such charges will be indicated at the time of placing your order.

Shipping Fees: Delivery is free for orders of $49 or more (before taxes) within the serviced areas. Specific shipping fees apply to orders below this amount and will be indicated at the time of placing your order.

Estimated Delivery Times:

• For products in stock at the Laval warehouse at the time of the order: 3 to 7 business days.
• For products requiring transfer from another store to the Laval warehouse: 5 to 9 business days

The timelines mentioned above are estimates only and may vary due to reasons beyond our control, including stock shortages or unforeseen carrier delays.

In-Store Pickup: Available free of charge. A piece of identification and the credit card used for the purchase are required upon in-store pickup. In order to prevent fraud, Gosselin reserves the right to request any additional information deemed necessary to verify the buyer's identity in relation to the payment method used. If such information is insufficient or unreliable, Gosselin reserves the right to refuse delivery of any product and to cancel an order.

Returns and Refunds

Returns or exchanges are accepted within 14 days of receiving the order for both online and in-store purchases. Items must be returned in their original condition with all accessories, manuals, and packaging. Gosselin reserves the right to refuse a return at its sole discretion if these conditions are not met.

Return Fees:

• If Gosselin determines, at its sole discretion, that a product is defective or does not match its description, Gosselin will cover the return shipping costs.
• For all other eligible returns, return shipping costs are the responsibility of the customer.

"Best Price" Policy

Gosselin commits to matching a competitor's price on a product under certain conditions:

• The product must be identical and in stock at the competitor.
• The competitor operates and has a place of business in Canada and offers a base warranty identical to that offered by Gosselin.
• The request must be made before purchase or no later than 14 days after purchase from Gosselin.

Warranties and Gold Protection

New products are covered by manufacturer warranties. Used products come with a 90-day warranty.

In addition, if you opt for the Gold Protection program, it offers additional protection for 3 years on new products and 1 year on used products, including:

• Free repairs for manufacturing defects.
• Accidental damage coverage.
• Priority access to customer service.
  

Used Products

Gosselin may, at its sole discretion, agree to purchase used photo and video equipment or products under certain conditions. Evaluation criteria include:

• The condition of the product (appearance, functionality, accessories).
• Market demand for the equipment.
• Confirmation that the product is not subject to financing.
• Confirmation of the product's origin.

Use of the Website

Intellectual Property : All content on the Website, including texts, images, trademarks, and logos, is the property of Gosselin or its partners and is protected by intellectual property laws. No part of the Website may be copied, reproduced, or downloaded in any manner without the express consent of Gosselin.

Acceptable Use : It is prohibited to use the Website, or any part of its content, for illegal or unauthorized purposes, including the infringement of intellectual property rights or the transmission of harmful content. Users are not authorized to use tools (including software or scripts) or any other methods to copy, monitor, or access the Website or its content in a manner inconsistent with normal use by a real user. Gosselin reserves the right to prohibit and suspend any access (including customer accounts) to the Website in cases of behavior or use deemed abusive, fraudulent, or contrary to these Terms and Conditions.

Limitation of Liability

Direct or Indirect Damages: Gosselin shall not be held liable for any direct, special, indirect, or consequential damages, or any other damages of any nature whatsoever, resulting from the use of or inability to use the Website or the products and services purchased through it.

Gosselin's liability in connection with the purchase of a product or service or the use of the Website is limited to the amount actually paid by the customer for said product or service.

Limitation of Liability Regarding Organic Search Engine Results: Results displayed in search engines such as Google, Bing, or Yahoo may include information automatically extracted from websites, including those of Gosselin Photo Vidéo's Website.

These so-called "organic" results are generated independently by search engine algorithms and may not reflect the accuracy, completeness, or currency of the information on the Website.

Gosselin Photo Vidéo shall not be held liable for any inaccuracies in content, prices, promotions, descriptions, or erroneous links displayed by third parties in these organic results. In the event of a discrepancy between organic search results and those on the Website, the latter shall take full precedence.

We recommend that customers always verify information — including prices, availability, delivery conditions, and product specifications — directly on our Website before making a purchase.

In the event of any inconsistency between these Terms and the specific conditions displayed or applicable to a particular section of the Website, the specific conditions shall prevail.

Amendments to the Terms

Gosselin reserves the right to modify these Terms and Conditions at any time. Modifications will take effect upon publication on the Website.

Gosselin reserves the right, at its sole discretion and without notice, to terminate access to its Website and to block or interrupt any access to it (including the indefinite suspension of any customer account for abusive use).

Governing Law and Severability

These Terms and Conditions are governed by the laws applicable in the Province of Quebec, Canada. Any dispute or conflict must, regardless of the user's place of residence, be brought before the appropriate court in the district of Montreal.

If any provision of these Terms and Conditions is found to be illegal, void, or unenforceable for any reason, that provision will be considered severable from these Terms and Conditions and will not affect the validity and enforceability of the remaining provisions.
